Terms of Service

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and Dary STEM (“Dary STEM”, “we”, “us”) governing your use of the Dary STEM website, applications, and services (the “Platform”). They are intended to have legal effect under Ghana’s Electronic Transactions Act, 2008 (Act 772). By creating an account or using the Platform, you accept these Terms. If you do not agree, please do not use the Platform.

2. Who may use Dary STEM

• Students under 18 may use the Platform with the consent and involvement of a parent or guardian, or through a school or teacher that has enrolled them.
• Teachers and parents must be at least 18 years old and able to enter into this agreement.
• You agree to provide accurate information and to keep your account details up to date.

3. Your account

You are responsible for activity on your account and for keeping your password confidential. Tell us promptly at support@darystem.com if you believe your account has been used without your permission. We may refuse, suspend, or close accounts that breach these Terms.

4. Acceptable use

When using the Platform, you agree not to:

• break the law or infringe the rights of others;
• harass, bully, or harm other users, or post unlawful, hateful, or harmful content;
• attempt to defeat, game, or interfere with grading, security, or the rights of other learners;
• probe, scan, scrape, overload, or disrupt the Platform or its infrastructure; or
• impersonate others or misrepresent your affiliation with a person or school.

5. Your content and submissions

You keep ownership of the work you create on the Platform — your code, circuits, projects, and other submissions. You grant us a limited, worldwide, royalty-free licence to host, store, display, and process that content only as needed to operate the Platform, deliver it to you and your teachers, grade it, and keep the service running. Teachers may view and grade the work of students in their classrooms.

6. Teacher-authored content

Teachers and authors are responsible for the courses and materials they create, and confirm they have the right to publish them. By publishing on the Platform, authors grant us the licence needed to host and deliver that content to learners. We may remove content that breaches these Terms or the rights of others.

7. Fees, free access, and the marketplace

Core learning on Dary STEM is free for students. Where the Platform offers paid items through the marketplace, the price and terms are shown before purchase, and purchases by a child require parental or guardian approval. Payments are handled by our payment provider; applicable taxes may apply. Refunds, where offered, follow the terms shown at the point of purchase.

8. Intellectual property

The Platform itself — including its software, simulators, design, branding, and the course content we provide — is owned by Dary STEM or its licensors and is protected by law. You may use it only as permitted by these Terms. “Dary STEM” and our logo are our marks and may not be used without permission.

9. Certificates

Certificates issued by the Platform recognise the completion of Dary STEM courses and activities. They are a record of work done on the Platform and are not, on their own, a formal academic qualification or accreditation unless we state otherwise in writing.

10. Availability and changes

We work to keep the Platform available and reliable, but we provide it on an “as is” and “as available” basis. We may add, change, or remove features, and we may carry out maintenance that temporarily interrupts the service. We will try to give notice of significant planned changes.

11. Disclaimers and liability

To the fullest extent permitted by the laws of Ghana, we exclude implied warranties and are not liable for indirect or consequential loss, or for loss of data or profit, arising from your use of the Platform. Nothing in these Terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

12. Suspension and termination

You may close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Platform or its users. On termination, the sections of these Terms that by their nature should survive will continue to apply. How we handle your data after closure is described in our Privacy Policy.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Ghana. Subject to any rights you have under mandatory consumer-protection law, the courts of Ghana have jurisdiction over any dispute, and we encourage you to contact us first at support@darystem.com so we can try to resolve it directly.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the effective date; significant changes will be communicated to account holders. Continuing to use the Platform after a change means you accept the updated Terms.
